The student and I continued to review topics in Chapter 18 related to performance and remedies. We reviewed the concept related to "good faith", and also the difference between material vs. nonmaterial breach and how to determine whether or not a breach is material (e. g. based upon time). We also learned more about anticipatory breach, whether or not the party who had to perform the initial action can obtain recovery, excuses for nonperformance (including impossibility and impractibility) that result in "no breach" and six additional situations that result in discharge (from the contract). Finally, we started covering the remedies associated with a breach of contract.
