Recent Administrative Law Tutoring Session Notes
Reviewed legal writing paper on Second Circuit case of Clearing House Associations v. Cuomo. Made suggestions for improvement in writing and substantive criticism of the Second Circuit's decision; made notes of legal definitions the student could use, since only legal dictionaries could be used. Edited paper for clarity; made suggestions re: what to cover in the paper.
The student wrote out the vocabulary for the class and then we went through the text using examples of complex litigation to apply the various terms and procedures inherent in such law suits.
We covered basic case briefing and issue spotting. The student practiced with understanding legal writing and how to extract relevant facts from a brief. We went over a case together where I explained procedural history of a case, facts, understanding how to name the parties and which court the case is in. I also gave him a case to brief for next session and a cheat sheet on case briefs. We are moving in the right direction.
The student and I worked on two different articles that she has reviewed in class. She received a 51/70 on her last exam and wants to bring that score up for her next test. She is having trouble understanding some of the concepts her teacher reviews in class and will highlight and mark down anything she doesn't follow for us to review next session. She and I will review her most recent test the next time we meet.
The student has a difficult assignment requiring that he calculate certain financial data based only on a real credit agreement between various banks and a store's 10k report. I walked him through finding the relevant quantities and making the required calculations. The assignment also requires that he draft some new provisions, and we talked about that and he laid out a plan for it.
We discussed the general process of evaluating gross income, above the line deductions, and below the line deductions. We also discussed the policy reasons for different treatment of certain deductions. I explained and illustrated section 83(b) tax elections, depreciation, and capital recovery/useful life.
